Builder in Landmark Pensions Ruling
2nd Apr 2008

A Co Dublin building firm has been ordered by the High Court to pay pension contribution of more than €180,000 into a fund for its workers, in a landmark court case.

Following an application by the Irish Pensions Board, Ms Justice Laffoy ordered Limestone Construction to pay the amount outstanding to the Construction Workers Pension Scheme and also to register their 200 workers with the scheme.

The board claimed that although money was deducted from workers' pay between June 2006 to September the following year, the company failed to make employers contributions into the pension’s fund.

After an investigation the board found the firm had failed to pay contributions and brought the legal case to the High court.

However, the board expressed concerns about Limestone‘s current financial situation, as it no longer owns its assets and owes a lot of money to creditors.

The firm however, did not defend the action and has 14 days to comply with the court's order.
